User Safety & Risk Addendum

1. Real-World Use Warning

Trouvé is designed for real-world treasure hunting activities that require physical movement and exploration. These activities inherently involve risks that are beyond our control, including but not limited to:

• Physical injury from falls, trips, or accidents
• Exposure to weather conditions and environmental hazards
• Encounters with wildlife or dangerous animals
• Interaction with strangers or potentially dangerous individuals
• Traffic accidents while traveling to cache locations
• Getting lost or stranded in unfamiliar areas
• Exposure to hazardous materials or unsafe conditions

2. Assumption of Risk

By using Trouvé, you expressly assume all risks associated with participating in real-world treasure hunting activities. You acknowledge that:

• You are participating voluntarily and at your own risk
• You are responsible for your own safety and well-being
• You will exercise reasonable caution and common sense
• You will not engage in activities that are clearly dangerous or illegal
• You will respect private property and local laws
• You will not trespass or enter restricted areas

3. Emergency Disclaimer

Trouvé is not an emergency service and should not be relied upon for emergency assistance. In case of emergency:

• Call emergency services (911 in the United States) immediately
• Do not rely on the app for emergency communication
• Follow local emergency protocols and procedures
• Seek medical attention for any injuries

We are not responsible for providing emergency assistance or coordinating rescue operations.

4. Waiver of Liability

To the maximum extent permitted by law, you hereby waive, release, and discharge Trouvé, its officers, directors, employees, agents, and affiliates from any and all claims, damages, injuries, or losses arising from or related to your use of the app, including but not limited to:

• Personal injury or death
• Property damage or loss
• Emotional distress or mental anguish
• Financial losses or expenses
• Medical expenses and treatment costs
• Lost wages or income
• Any other damages or losses

5. Indemnification

You agree to indemnify, defend, and hold harmless Trouvé, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the Trouvé app
• Your participation in treasure hunting activities
• Your violation of these terms or applicable laws
• Your negligence or intentional misconduct
• Any harm caused to third parties

6. Safety Guidelines

While we cannot guarantee your safety, we strongly recommend following these guidelines:

• Always tell someone where you're going and when you expect to return
• Carry a fully charged phone and emergency contact information
• Dress appropriately for weather conditions and terrain
• Stay aware of your surroundings and trust your instincts
• Do not enter private property without permission
• Avoid dangerous areas, especially at night
• Do not take unnecessary risks for rewards
• Follow local laws and regulations
• Respect wildlife and natural environments

7. Medical and Physical Considerations

Before using Trouvé, consider your physical condition and any medical limitations:

• Consult with a healthcare provider if you have medical conditions
• Do not participate if you are under the influence of drugs or alcohol
• Consider your fitness level and physical limitations

By using Trouvé, you acknowledge that you have read, understood, and agree to this Risk Addendum. You understand that:

• Real-world treasure hunting involves inherent risks
• You are responsible for your own safety
• Trouvé is not liable for injuries or damages
• You assume all risks voluntarily
• This addendum is legally binding
